Monthly Member Meeting | Navigating Alimony When the Divorcing Parties Have Been Married for 20 Years or More
Approved for:
1 General CLE Credit
1 Marital and Family Law Certification Credit
Description:
This presentation will be presented by attorney Lynne Strober from New Jersey and attorney Anthony Diaz from Florida. Anthony will talk about how Permanent alimony was recently terminated in Florida and what the effects of that have been. Lynne will explain how Alimony is handled in New Jersey with open durational alimony.
To provide for alimony in long term marriages that is as fair as possible, parties are faced with the real possibility of future problems. The payor won’t be able to pay or think it is fair to pay and the recipient will have to worry about when they risk losing their alimony and the cost of litigation.
In almost all cases it is best to try to resolve these issues out of court. Negotiation provides the attorney the most control over the outcome. However, reasonableness needs to prevail to resolve the alimony issues.
When there is a review, financial advisors and forensic accountants may be called upon to analyze whether there is a change in circumstances. Appraisers and realtors may be involved in reviewing the value of the real property owned by each party. Real property may need to be sold to provide a cash flow to the alimony recipient or payor. If there is an issue with a party’s mental or physical health experts may be brought in to evaluate and opine.
